The following General Terms and Conditions (hereinafter, “Terms and Conditions”) apply to participation in the Wiber Rent a Car Affiliate Program (hereinafter, “Wiber Rent a Car”) and the affiliate (hereinafter, “Affiliate”). Please read these Terms carefully. To use the Affiliate Program, you must accept the general and specific Terms and Conditions of the Wiber Rent a Car Affiliate Program. You will accept these Terms and Conditions by registering in the “Affiliate” section on our website.

If you accept these clauses, you will be considered aware of the rights and obligations that arise from what is stipulated in these Terms and Conditions.

1. Object of the contract

The purpose of these Terms and Conditions is to introduce Wiber Rent a Car's Affiliate Program to the Affiliate, which allows the Affiliate to earn a commission for transactions made on Wiber Rent a Car's website (www.wiberrentacar.com) via a link inserted on the Affiliate’s website.

2. Ownership

On the one hand, individuals or legal entities who own a website may participate in Wiber Rent a Car’s Affiliate Program, provided they have sufficient capacity for it. The owner, if it is a legal entity, will act through its legal representative with the authority to manage the website. On the other hand, Wiber Rent a Car is the owner of this contract.

3. Applicable Law

All transactions carried out under these Terms and Conditions will be governed by the agreements stipulated therein, which the parties declare they are aware of and accept.

4. Operation of the Affiliate Program

4.1 Registration and acceptance

The applicant must be an individual over 18 years old or a legally constituted legal entity (through the individual who has the legal capacity to represent it), with full capacity to contract.

The application for appointment as an Affiliate means that the Affiliate accepts the Terms and Conditions and agrees to comply with them.

In order to participate as an Affiliate in Wiber Rent a Car's Affiliate Program, the Affiliate must:

• Fully complete the registration form.
• Confirm that they accept the general Terms and Conditions.
• Be accepted by Wiber Rent a Car.

After fully completing the registration form, the following steps are required for the candidate to be accepted as an Affiliate by Wiber Rent a Car:

• Wiber Rent a Car will review the Affiliate’s website(s) to ensure that their contents do not violate the law, morality, or public order, and that they do not harm Wiber Rent a Car’s image.
• Wiber Rent a Car will confirm the acceptance or rejection of the candidate into the Affiliate Program via email.
• Once accepted, the Affiliate will have access to a link where they will need to define their username and associated password, which can be changed, and after registration, they will be able to use the Affiliate area.

The Affiliate guarantees that the information provided to Wiber Rent a Car about themselves and their website is true and complete, and that this information reflects their current status.

4.2 Use

The Affiliate must use only the name and material provided by Wiber Rent a Car for the Affiliate Program, as specified, and follow Wiber Rent a Car's instructions. The Affiliate must use the provided content without modification.

The services offered on the Wiber Rent a Car website may change regularly. The Affiliate must ensure that the Terms and Conditions of these services on their website match those mentioned on the advertiser's website.

Affiliates may not use the materials for illegal activities or conduct that violates applicable law or these Terms. This includes but is not limited to:

• Illegal activities or inciting others to engage in them.
• Harm to Wiber Rent a Car’s reputation.
• Copyright, trademark, or other violations of Wiber Rent a Car's or third parties' rights.
• Violent, pornographic, or related content.
• Discrimination based on race, gender, religion, or philosophy of life.

If Wiber Rent a Car finds the Affiliate’s use of the link inappropriate, it reserves the right to block it. The Affiliate agrees to remove a link from their website within 24 hours if requested by Wiber Rent a Car.

Wiber Rent a Car may modify or terminate any Affiliate Program at any time.

The Affiliate must keep up to date with any changes to Affiliate Programs, especially regarding the commission structure or Program termination.

The Affiliate may not generate artificial traffic on linked websites. The Affiliate must notify Wiber Rent a Car immediately if they become aware of any misuse of Affiliate links.

The Affiliate cannot use the Wiber Rent a Car brand or trademark for PPC purposes on search engines or advertising platforms unless expressly authorized by Wiber Rent a Car in writing. Redirection pages or links to send users to Wiber Rent a Car’s site are also prohibited.

Unless expressly agreed in writing, the Affiliate cannot transfer or promise their rights and/or obligations to a third party without prior written consent from Wiber Rent a Car.

The Affiliate may not personally benefit from the discounts applicable to their account by making reservations for their own use through their link or promotional code.

4.3 Remuneration

The commission paid to the Affiliate will be 10% or 12%, depending on the chosen collaboration model. The commission is calculated on the net rental rate, including any promotional discounts and excluding extras reserved by the customer.

Billing periods will be monthly if the commission exceeds €1,000 per month. Otherwise, it will be quarterly or annually, depending on when this amount is reached.

The Affiliate can claim a commission if a customer purchases services from Wiber Rent a Car, provided the action is registered through the link on the Affiliate's website, and the transaction occurs during the cookie storage period (7 days).

The Affiliate will only be paid if Wiber Rent a Car approves the transaction as complete. A complete transaction corresponds to a car rental contracted with the “Top Cover” insurance and fully paid.

Once a user has made a booking with Wiber Rent a Car, they are subject to the Wiber Rent a Car Terms and Conditions they accepted at the time of booking.

Commission will be paid only if Wiber Rent a Car has received full payment from the customer. Payments to the Affiliate will be made directly to their bank account, and Wiber Rent a Car will contact the Affiliate to provide bank account details, including the bank’s name, branch, and account number.

If payment is made to an Affiliate's foreign bank account, bank fees will be deducted from the payment.

For individual residents in Spain, IRPF withholding tax will be applied in accordance with Spanish law. For non-resident individuals or legal entities based in countries without a double taxation agreement with Spain, IRNR withholding tax will be applied in accordance with Spanish law. The Affiliate is responsible for paying taxes and social security contributions in their country through the invoices issued by Wiber Rent a Car.

5. Consent

The Affiliate is fully responsible for the development, maintenance, operation, and content of their website.

Wiber Rent a Car is not responsible for errors in the implementation of links on the Affiliate's website or link functionality.

Wiber Rent a Car is not liable for defects in the Affiliate Program, interruptions to access, data breaches, or loss of data in the processing system. It is also not responsible for security defects, viruses, or other harmful software used by the Wiber Rent a Car Affiliate Program, nor for damages caused by viruses or components in the Affiliate's software or website.

7. Intellectual Property

The copyright and intellectual property rights for reports, recommendations, and other products, services, or documents produced for the Affiliate will always belong to Wiber Rent a Car. Written consent from Wiber Rent a Car is required if the Affiliate wishes to reproduce or publish these products, services, or documents.

The Affiliate may not publish or share the specified elements or the information and expertise described in them, except with written consent from Wiber Rent a Car.

It is not permitted for the Affiliate to remove or modify any trademarks related to copyright, trademarks, trade names, or other intellectual property or industrial property rights on software, equipment, or materials.

If the Affiliate neglects to comply with this clause, Wiber Rent a Car is entitled to recover all relevant elements at the Affiliate's expense.

8. Confidentiality

The Affiliate must refrain from making any statements to third parties or providing information about the methods used or data provided by Wiber Rent a Car before, during, and after the Affiliate Program.

9. Collaboration duration

The collaboration is indefinite. However, either party may terminate it at any time without cause, via email.

Wiber Rent a Car has the right to terminate collaboration immediately or deny the Affiliate the right to use the Affiliate Program in the following cases:

• If, in Wiber Rent a Car's opinion, the Affiliate's website violates public order or decency or may be offensive or violent.

• If the Affiliate does not fully comply with obligations or commits fraud or illegal acts in any way, generates or attempts to generate artificial traffic, or violates any of these Terms and Conditions.
• If the Affiliate has not generated traffic for one year.

If the Affiliate Program ends, for any reason:

• • Links will be destroyed.
• Wiber Rent a Car will block the Affiliate's access to the Wiber Rent a Car website.
• The Affiliate will no longer be able to claim commissions.
• The Affiliate will delete or return all links and/or materials provided by Wiber Rent a Car.
• The Affiliate will no longer be able to claim commissions.

The Affiliate may claim commission for transactions completed before the termination date, unless the collaboration is terminated due to Wiber Rent a Car’s decision based on the Affiliate's breach of these Terms and Conditions or because the content of the Affiliate's website does not comply with these predefined rules.

10. Protection of Personal Data

Wiber Rent a Car processes all received information in accordance with the GDPR and the terms of this Privacy Policy and Cookies Policy.

The Affiliate expressly agrees to notify Wiber Rent a Car of any updates or other modifications regarding the data provided, with Wiber Rent a Car not being responsible for possible outdated information.

The Affiliate may revoke the consents granted in this document at any time, as well as exercise their rights of access, rectification, cancellation, and opposition, by submitting their request in writing, duly proving their identity, to the email address affiliates@wiberrentacar.com.

11. Applicable Law

These General Conditions shall be governed and interpreted in accordance with Spanish law.

12. Competent Jurisdiction

In case of litigation between Wiber Rent a Car and the Affiliate, the latter may bring their action before the Spanish courts corresponding to Wiber Rent a Car’s domicile or the courts where the User is domiciled.
