× This document contains the General Terms and Conditions of Use and Contracting (hereinafter, 'the General Terms') which, together with the Privacy and Cookies Policy, govern the access and use by the User (hereinafter, 'the User') of the Website https://www.wiberrentacar.com/ (hereinafter, 'the Website'), as well as the contracting of services through it. By accepting this document, the User declares:
The use of the Website grants the status of User and implies acceptance of all the terms included in this document. The User must carefully read this document each time they visit the Website, as it may be subject to modifications.
The owner of the Website reserves the right to make, at any time and without prior notice, any modification or update to the contents and services outlined in this document and, in general, to all elements that make up the design and configuration of the Website.

2.Access to the Website and Registration
Simple access to the Website is free, except for the cost of the connection through the telecommunications network provided by the access provider contracted by the User.
In general, access to the content of the Website will not require User registration, although the use of certain services may be subject to prior registration.
The data entered by the User must be accurate, current, and truthful at all times. The registered User will always be responsible for the data they enter. In this regard, the User will be liable in any case for the data they have provided.
3. Rules for Using the Website
The User agrees to use the Website as well as all its content and services in accordance with the law, morality, public order, and this document. Likewise, the User agrees to make appropriate use of the services and/or content of the Website and not to use them to carry out illegal or criminal activities that infringe the rights of third parties and/or violate intellectual and industrial property regulations, or any other rules of the applicable legal system.
By way of example and in no case limiting or excluding, the following is prohibited:
Failure by the User to comply with any of the above obligations may result in Wiber Rent a Car taking necessary measures, including the deletion or blocking of the User's account.
Wiber Rent a Car reserves the right of admission.
4. Conditions for renting a car with Wiber Rent a Car.
The purpose of Wiber Rent a Car is to inform and provide good faith access to the vehicle rental services offered, grant the possibility to book them, and communicate Wiber Rent a Car’s commercial proposals. This service is solely directed towards retail services (consumers and users).
The products and services that Wiber Rent a Car may provide to Users will require, as necessary, prior acceptance of the General Terms of Service displayed on the screen, and will be subject to the specific conditions of the requested service.
According to current regulations, the User may cancel the reservation at any time up to 24 hours before the scheduled time without additional cost. Improperly canceled charges by the user in the case of credit card payment, under current legislation, may result in the obligation to pay damages by the User.
The scope of the vehicle rental service is limited to Spanish territory.
Wiber Rent a Car reserves the right to temporarily suspend the 'wiberrentacar.com' service without prior notice. Additionally, Wiber Rent a Car may restrict specific offers in terms of the number of days they are available, the vehicle category or model, or the branch or location where the offer is provided. Reservations with fraudulent intent or that constitute unfair competition against Wiber Rent a Car are strictly prohibited and may be canceled by Wiber Rent a Car.
The applicable law for the content reflected on the Wiber Rent a Car pages will be Spanish law, subject to the jurisdiction of the competent Courts and Tribunals in Spain.
The free and voluntary activation of the 'wiberrentacar.com' service by the User constitutes the explicit acceptance of these terms.
The User is aware that the vehicles they rent may not be owned by Wiber Rent a Car but by third-party vehicle providers. For these purposes, the User acknowledges that, in the case of traffic fines, their data may be communicated to these vehicle owner and provider companies for the purpose of identifying the driver.
5. Hiring process at Wiber Rent a Car
The hiring process for vehicle rental through Wiber Rent a Car is as follows:
a. El Usuario deberá acceder al sitio web www.wiberrentacar.com y seleccionar las fechas en las que desea hacer uso de un vehículo alquilado así como el lugar en el que se recogerá el vehículo.
b.Once the User has selected the location and date they wish to rent the vehicle, they must select the vehicle to rent from a list of vehicles displayed on the website. For each vehicle, Wiber Rent a Car provides information on the same website about its features/equipment (e.g., number of doors, maximum number of occupants, maximum luggage capacity, type of vehicle - manual or automatic, as well as its energy rating).
c. Once the User has chosen the vehicle that best suits their needs, they must select between two types of services: 'All inclusive' or 'Full/Full'. The User can see the prices of these two services and what benefits/services each of them includes.
d. Next, if the User deems it appropriate, they may contract additional services offered by Wiber Rent a Car through the website by clicking on the 'Show extras' button.
e. Finally, the User must choose the payment method for the services they are most interested in: Visa or Mastercard credit card, or select 'Pay on pickup'. Depending on the chosen payment method, Wiber Rent a Car may apply discounts, which the User can view when determining the 'Payment options'.
f. Para finalizar con el proceso de contratación, el Usuario deberá cumplimentar sus datos personales y clicar sobre el botón “Confirmar mi reserva”, previa aceptación de las presente Condiciones Generales.
g. Los lugares de recogida y entrega de los vehículos serán los determinados durante el proceso de contratación.
6. Billing
El Usuario sabe y acepta que Wiber Rent a Car sólo le enviará sus facturas al correo electrónico que haya facilitado durante el proceso de registro. No obstante, el Usuario puede solicitar en cualquier momento que las facturas se le remitan en papel, para lo cual deberá enviar su solicitud a reservas@wiberrentacar.com.
7. Incidencias, quejas, reclamaciones y solicitudes de información
Para cualquier incidencia, queja, reclamación o solicitud de información el Usuario puede contactar por cualquiera de las siguientes vías:
Wiber Rent a Car dará respuesta a las reclamaciones recibidas en el plazo más breve posible y en todo caso en el plazo máximo de un mes desde la presentación de la reclamación.
Wiber Rent a Car dispone de hojas de queja/reclamación/denuncia que el Usuario podrá solicitar en los mostradores de las diferentes delegaciones.
8. Propiedad intelectual e industrial
Todos los contenidos del Sitio Web, como por ejemplo los textos, fotografías, gráficos, imágenes, iconos, tecnología, software, links y demás contenidos audiovisuales o sonoros, así como su diseño gráfico y códigos fuente, son propiedad intelectual de Wiber Rent a Car o han sido licenciados a Rent a Car por los terceros titulares de los derechos sobre dicho contenido y están protegidos por derechos de propiedad intelectual e industrial.
Las marcas, nombres comerciales o signos distintivos son titularidad de Wiber Rent a Car o terceros, sin que pueda entenderse que el acceso al Sitio Web atribuye algún derecho sobre los mismos.
All Intellectual Property, Industrial Property, and Image rights over all original content published by the User on the Platform will be respected and recognized, with the User granting Wiber Rent a Car only the rights necessary for the proper exploitation and promotion of the service and the Website by Wiber Rent a Car, worldwide. This transfer of rights is limited to the use by Wiber Rent a Car for the exploitation and promotion of the Website while the User is registered on the Website.
Wiber Rent a Car will not be responsible for the use that third-party Users make of their own or third-party content on the Website, and is exempt from all liability in this regard.
9. Linked content and services through the Website
The service for accessing the Website includes technical linking devices, directories, and even search tools that allow the User to access other pages and internet portals (hereinafter, “Linked Sites”). In such cases, Wiber Rent a Car will only be responsible for the content and services provided on the Linked Sites insofar as it has actual knowledge of their illegality and has not deactivated the link with due diligence. If the User believes there is a Linked Site with illegal or inappropriate content, they may notify Wiber Rent a Car, without this notification obliging the removal of the corresponding link.
In no case should the existence of Linked Sites imply the formalization of agreements with the parties responsible for or owners of them, nor should it imply Wiber Rent a Car's recommendation, promotion, or identification with the statements, content, or services provided.
Wiber Rent a Car does not know the content and services of the Linked Sites and is therefore not liable for any damages caused by the illegality, quality, outdatedness, unavailability, error, or uselessness of the content and/or services of the Linked Sites, nor for any other damage that is not directly attributable to Wiber Rent a Car.
10. Service Guarantee
At Wiber Rent a Car, we make our best efforts to ensure the continuity, security, and quality of the Website based on the current state of the art. However, we cannot guarantee the permanent availability and continuity of the Website’s operation, the absence of viruses or other elements that may alter your computer system, nor the reliability, usefulness, truthfulness, accuracy, completeness, and timeliness of the information contained on the Website. Therefore, we are not liable if any of these circumstances occur.
11. Nullity and ineffectiveness of clauses
If any clause included in these General Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, with the remaining General Conditions remaining in effect in all other respects, and such provision will be considered as not included, in whole or in part.
12. Applicable Law
These General Conditions shall be governed and interpreted in accordance with Spanish law.
13. Competent Jurisdiction
In the event of a dispute between Wiber Rent a Car and the User, the latter may file their action before the Spanish courts corresponding to the domicile of Wiber Rent a Car, or before the courts of the place where the User is domiciled.
